Welcome to Quimbaya.

These Terms of Service (“Terms”) govern your access to and use of the Quimbaya website, including all purchases made through our online store. By visiting our website or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website.

Nothing in these Terms limits any statutory consumer rights that cannot legally be excluded under applicable law.

3. Product Information

 

We make every effort to present our fragrances, packaging and product descriptions as accurately as possible.

However, minor differences may occur due to photography, screen settings, manufacturing updates or legal compliance requirements.

Where fragrances contain natural ingredients, slight variations in colour may occur between production batches. These variations are normal and do not affect the quality or authenticity of the fragrance.

From time to time, ingredients or formulations may be updated to comply with applicable safety regulations, including IFRA standards and European legislation. Such changes shall not be considered defects.

 


4. Orders

 

Submitting an order constitutes an offer to purchase a product.

An order is only accepted once you receive an order confirmation from Quimbaya.

We reserve the right to refuse, limit or cancel any order where reasonably necessary, including where:

  • payment cannot be authorised;
  • fraudulent or unlawful activity is suspected;
  • pricing or product information contains an obvious error;
  • products become unavailable;
  • shipment is restricted by law or carrier regulations.

If payment has already been received for a cancelled order, the amount paid will be refunded using the original payment method.

 


5. Prices & Payment

 

All prices displayed on our website are shown in the selected currency.

Prices may change without prior notice but will never affect an order that has already been confirmed.

Shipping charges, taxes and import duties are calculated separately where applicable and are displayed during checkout whenever possible.

Payment must be successfully authorised before an order can be processed.

 


6. Availability

 

Although we aim to maintain accurate stock information, availability cannot be guaranteed.

If a product becomes unavailable after an order has been placed, we may cancel the affected order or offer an appropriate alternative or refund.

 


7. Shipping

 

Shipping is carried out in accordance with our Shipping & Returns Policy, which forms part of these Terms.

Estimated delivery times are provided for guidance only.

Delays caused by customs authorities, shipping carriers, weather conditions, public holidays or circumstances beyond our reasonable control do not constitute a breach of these Terms.

 


8. Right of Withdrawal & Returns

 

Consumers within the European Union benefit from the statutory right of withdrawal provided under applicable consumer legislation.

Because perfume is a sealed product intended for personal use, opened or unsealed fragrances cannot be returned once the protective seal has been broken, except where required by law or where the product is defective.

9. Product Safety

 

Our fragrances are intended exclusively for external use.

Please avoid contact with the eyes, keep products out of reach of children and discontinue use if irritation occurs.

As with all cosmetic products, customers should review the ingredient list before use to determine whether any known allergies may apply.

Fragrances should be stored away from excessive heat, direct sunlight and open flames to preserve their quality.

 


10. Intellectual Property

 

All intellectual property rights relating to Quimbaya remain the exclusive property of Quimbaya or its licensors.

This includes, but is not limited to:

  • the Quimbaya name;
  • logos;
  • fragrance names;
  • bottle designs;
  • packaging;
  • photography;
  • campaign imagery;
  • product descriptions;
  • written content;
  • artwork;
  • graphics;
  • videos;
  • website design and layout.

No material from this website may be copied, reproduced, distributed, modified, published or commercially exploited without our prior written consent.

 


11. Limitation of Liability

 

Nothing in these Terms excludes or limits liability where such exclusion is prohibited under applicable law.

To the fullest extent permitted by law, Quimbaya shall not be liable for indirect, incidental, consequential or special damages, including but not limited to loss of profit, loss of business, loss of data or business interruption.

Our liability relating to any purchase shall never exceed the amount paid by the customer for the relevant order.

Quimbaya shall not be responsible for damage resulting from:

  • improper storage of products;
  • misuse of products;
  • allergic reactions where ingredients have been accurately disclosed;
  • failure to follow product instructions;
  • normal wear of packaging after delivery.

 


12. Force Majeure

 

We shall not be liable for delays or failure to perform our obligations where such delay or failure results from events beyond our reasonable control.

These events include, but are not limited to:

  • natural disasters;
  • pandemics;
  • strikes;
  • war or civil unrest;
  • governmental actions;
  • transport disruptions;
  • supply chain interruptions;
  • cyberattacks;
  • failures of third-party service providers.
